Terms of Service

1. Acceptance of Terms

By creating an account or using Switch ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms at any time; continued use after changes constitutes acceptance.

2. Description of the Service

Switch is a multi-model AI chat platform that provides unified access to multiple large language models, including Claude, ChatGPT, Gemini, Perplexity, DeepSeek, and Grok. The Service includes intelligent query routing (Switch Mode), side-by-side model comparison (Compare Mode), conversation history, project workspaces, file uploads, and related features.

Switch does not create the AI models. We route your queries to third-party AI providers and present their responses. The accuracy, quality, and safety of AI-generated responses are subject to the capabilities and limitations of the underlying models.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to notify us promptly if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Billing

Switch offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

  • Free Tier: Limited daily queries and feature access at no cost
  • Paid Tiers (Starter, Pro, Power): Expanded or unlimited access to models, features, and usage quotas as described on our pricing page

Prices are subject to change with notice. Upgrades take effect immediately with prorated billing. Downgrades take effect at the end of the current billing period.

5. Cancellation and Refunds

You may cancel your subscription at any time through the Stripe billing portal accessible from your account settings. Upon cancellation, you retain access to your paid tier until the end of the current billing period, after which your account reverts to the Free tier.

Refunds are handled on a case-by-case basis. Contact us at support@theswitchai.com for refund requests.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Generate, store, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Attempt to circumvent rate limits, authentication, or access controls
  • Reverse-engineer, decompile, or attempt to extract the source code or routing algorithms of the Service
  • Use automated scripts, bots, or scrapers to access the Service without authorization
  • Interfere with or disrupt the Service or its infrastructure
  • Impersonate another person or entity
  • Upload files containing malware, viruses, or malicious code

We reserve the right to suspend or terminate access for violations of this policy without prior notice.

7. AI-Generated Content

Responses provided through the Service are generated by third-party AI models. You acknowledge that:

  • AI-generated content may be inaccurate, incomplete, or misleading
  • You should not rely on AI responses as professional, legal, medical, or financial advice
  • You are responsible for evaluating and verifying any AI-generated content before acting on it
  • Switch does not endorse, guarantee, or assume liability for AI-generated outputs

8. Intellectual Property

The Switch platform, including its design, routing engine, and user interface, is owned by Switch. You retain ownership of the content you input into the Service. You grant us a limited license to process your content as necessary to provide the Service (e.g., sending queries to AI providers, storing conversation history).

Ownership of AI-generated content is subject to the terms of the underlying AI providers. We make no claim of ownership over AI-generated responses.

9. Third-Party Services

The Service integrates with third-party AI providers (Anthropic, OpenAI, Google, Perplexity, DeepSeek, xAI) and infrastructure services (Stripe, Supabase, Vercel, GitHub). Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for the availability, performance, or policies of third-party services.

10. Service Availability

We aim to provide reliable access to the Service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control, including third-party provider outages. We are not liable for any loss arising from Service downtime.

11. Limitation of Liability

To the maximum extent permitted by law, Switch and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that AI responses will be accurate or reliable.

13. Indemnification

You agree to indemnify and hold harmless Switch and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may delete your account by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) will survive.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in San Francisco County, California.
